Abhishek Malhotra, Founding Partner, TMT Law Practice, has two decades of experience in the primary areas of expertise, including intellectual property, commercial dispute resolution, technology, media and telecommunications. He has advised clients in minimizing legal risks and devising strategies for safeguarding against civil and criminal liability. He has contributed significantly towards bridging the gap between legal challenges and transforming clients’ business goals into reality. Mr Malhotra’s expertise in the media sector has resulted in a close alliance with production houses, broadcasters, and artists across the industry, and he is recognized as the “go to” professional for issues across broadcasting, music and sports. He has contributed to the policy realm by providing inputs to the Government of India on copyright issues and proposed amendments to the Copyright Act, 1957, and as a Principal Advisor to the Broadband India Forum on issues relating to telecommunications, satellite communication, data privacy and broadcasting. Mr Malhotra is an expert in both prosecution and defense of suits; proceedings and appeals in respect of infringement of intellectual property rights; commercial litigation concerning employment, information technology and competition issues; drafting and negotiating agreements, especially pertaining to intellectual property and related fields i.e. media, information technology, broadcasting, pharmaceuticals; advising clients across luxury brands, information technology, media, hardware equipment manufacturing, pharmaceuticals, broadcasting; providing opinion on the creation, maintenance, management and enforcement of intellectual property rights, including assisting in the prosecution of trademarks and copyrights in India; commercial contracts; government advisory; criminal matters.
Mr Malhotra also advises and gives opinion on public policies and regulatory frameworks. He has provided inputs to the Government of India on issues such as copyright, data privacy and satellite communications. He was the Chairperson at the INTA Annual Conference on strategies for brand owners in BRIC countries (Seattle 2009). He advises several think-tanks and associations in the field of technology, media & telecommunications. Mr Malhotra is a member of the Bar Council of Delhi; California State Bar, California; Delhi High Court Bar Association; International Association of Entertainment Lawyers; American Bar Association; International Trademark Association (INTA); International Association for the Protection of Intellectual Property (AIPPI); and FICPI. Mr Malhotra believes in empowering the next generation, and is a guest lecturer at eminent institutions such as the Indian Institute of Information Technology. He has contributed to books on intellectual property, space law and sports law published by the Eastern Book Company and National Law School India University, Bangalore, his alma mater and India’s premier law institution. He regularly contributes papers on various upcoming and nascent laws, including those pertaining to the music industry, space law and clinical trials. He regularly speaks at conferences and forums of repute, including the National Judicial Academy in Bhopal, Indo-American Chambers of Commerce, World Intellectual Property Office, The Observer Research Foundation, MediaNama and FICCI. Mr Malhotra has completed his BA, LLB (Honors) from the National Law School of India University, Bangalore; and LLM. (IP) from Franklin Pierce Law Center, Concord, New Hampshire, USA. He cleared the California Bar Examination in July 2001.
