Mukesh Butani

Mukesh Butani is the Founder and Managing Partner of BMR Legal Advocates, an independent law firm specializing in tax policy and advocacy and disputes ranked among Tier 1 tax firms in India in independent surveys by Chambers & Partners, The Legal 500 and Asia Law. Having specialized in corporate international tax and transfer pricing for more than three decades, Mr Butani has significant experience in advising Fortune 500 multinationals and large Indian business houses on a wide range of matters related to trade and investment policy, reorganization, cross-border tax structuring, corporate international tax and controversy across sectors. Mr Butani was the leader of tax practices in Big 4 Accounting Firms. Thereafter, he co-founded and was Chairman of BMR Advisors, one of India’s leading professional services firm with competencies in the area of tax and M&A advisory services which transitioned into the Big 4 firms in August/September 2017. BMR Advisors featured in 2016 Harvard Business case studies taught in the IIMs in India and leading business schools in the US.

Mr Butani participated in the Kelkar Task Force (2002) tax reforms and was a member of the Indian Ministry of Finance Committee on e-commerce taxation. He is often called upon by Indian policymakers in general and by the Prime Minister’s Economic Advisory Council for GST and International Tax Policy matters in particular. He represented the International Chamber of Commerce, Paris (ICC) on the Ministry of Finance Standing Committee on TDS and Foreign Tax Credit. He served as a member of the expert task force on International Tax and Transfer Pricing set up by the Ministry of Finance. He deposed before the Parliamentary Standing Committee and other Ministry of Finance committees of the Government of India on Direct Tax Code, including GAAR, FII taxation, indirect transfers, transfer pricing etc. He was a member of the tax bureau of OECD-BIAC (2000-2012) and Permanent Scientific Committee of IFA (2012-2016), and is presently Chairman of IFA India branch and Vice-Chairman of the Taxation Commission of ICC Tax Commission, Paris.

Mr Butani served as a member of the Focus Group on administrative practices on tax disputes and under the Dr P. Shomeled Tax Administration Reform Commission (TARC) set up in August 2013. He was part of an expert group of economists before the NITI Aayog (2014), and is a member of the “Champions of Change” initiative of NITI Aayog (2014) which is a policy think tank of the Government of India chaired by the Indian Prime Minister. He is a founder member (2015) of the International Tax Research & Analysis Foundation (ITRAF), an independent think tank for research and analysis in the area of international tax policy to ensure superior policy and effective tax administration in India, including integration of domestic policies with OECD/G20-led Base Erosion and Profit Shifting (BEPS) initiative. He is a trustee at the Foundation for International Taxation, which in partnership with IBFD organizes its annual conference where he is the Joint Director. Mr Butani is a visiting faculty member at the Transfer Pricing Centre, Institute of Austrian and International Tax of Vienna University of Economics and Business, and at the Tax Policy Centre of the University of Lausanne. He is an ADIT Committee member at the UK Chartered Institute of Taxation, London. He plays an active role with the advocacy body US-India Business Council and is a non-resident Senior Associate at Wadhwani Chair in US-India policy studies at the Centre of Strategic and International Studies; both based in Washington DC.
