The Allahabad High Court has stayed the First Information Report (FIR) registered against the director and the manager of OPPO India Private Limited. The case pertained to the explosion of a mobile phone.
The division bench of Justice Mahesh Chandra Tripathi and Justice Subhash Vidyarthi observed that the proceedings prima facia seemed to be an abuse of the process of law. It ordered that the case required consideration.
An FIR was lodged against OPPO's officers alleging that the third respondent/informant bought a mobile phone from OPPO in 2019. A year later, the phone had exploded in his pocket due to which he sustained injuries.
The accused were booked for offences under the Indian Penal Code (IPC), 1860, Sections for causing hurt by act endangering the life or personal safety of others, causing grievous hurt, and playing mischief.
The petitioners moved the High Court seeking quashing of the FIR arguing that no offence was committed and they had been falsely implicated. They also submitted that the informant ought to have approached the District Consumer Dispute Redressal Commission/Consumer Court or the civil court for the redressal of his grievance.
The court said that the matter needed to considered and issued a notice while granting interim relief to the petitioners.
