AZB & Partners represented Fontaine Limited in trademark infringement suit before Delhi High Court

The leading law firm in India, AZB & Partners successfully represented Fontaine Limited in a trademark infringement suit before the Delhi High Court relating to Fontaine’s CREED brand of luxury perfumes.

Fontaine had approached the High Court seeking an injunction and damages against former distributors for illegally selling, promoting, and advertising CREED products. After granting an ex-parte ad interim injunction in favour of Fontaine, which was subsequently confirmed, the High Court allowed Fontaine’s summary judgment application and awarded damages and costs of approximately INR 45 Lakhs without requiring a trial.

The judgment articulated key principles for granting damages at the summary judgment stage, including appreciation of unchallenged evidence, reliance on evidence obtained through local commissions, and considerations for repeat offenders.
