Ravissant gets relief in design and copyright infringement case

The Delhi High Court grants an ex parte ad interim injunction in favor of Ravissant Private Limited, restraining Anil Kumar Jain Silver and Anil Kumar Jain & Co. from infringing the plaintiff's registered designs and copyright in original images of its products. The court found prima facie that the defendants had copied the plaintiff's original images and were selling products that infringed the plaintiff's registered designs.

The plaintiff, Ravissant Private Limited, is a well-known manufacturer and seller of home decor products, sterling silverware, and decorative pieces. The company has secured design registrations for its novel and unique designs and has original images of its products. The defendants were found to be selling nearly identical replicas of the plaintiff's products and using the plaintiff's original images, thereby infringing the plaintiff's design registrations and copyright.

The court observed that a prima facie case was made out in favor of the plaintiff, and the balance of convenience was in favor of the plaintiff. The court also noted that irreparable injury would be caused to the plaintiff if the defendants continued to sell products infringing the plaintiff's registered designs or using the plaintiff's original images.
