Trademark shield: Court protects SUPERON

The Delhi High Court has granted an ex parte ad interim injunction in favor of Sanjay Mehra, proprietor of the trademark 'SUPERON', restraining M/S KSS Electrodes Pvt. Ltd. from using the deceptively similar mark 'SUPERKON' for welding electrodes.

The court found prima facie that the defendant's mark was an attempt to closely resemble the plaintiff's registered trademark used for similar goods, likely causing public confusion.

This interim order prevents the defendants from manufacturing, selling, or dealing in any products under the 'SUPERKON' mark or any other mark deceptively similar to 'SUPERON' until the next hearing. The court observed the near identity of the marks and the identical nature of the goods and trade channels, establishing a strong initial case for the plaintiff against potential irreparable harm.
