The global law firm Dentons, through its Indian presence Dentons Link Legal, successfully secured interim relief for the Reserve Bank of India (“RBI”) in an appeal before the Division Bench of the Delhi High Court comprising the Chief Justice and Justice Tejas Karia.
The appeal challenged a judgment passed by a Single Judge of the Delhi High Court in a writ petition directing the RBI to implement a second-level human review for all complaints under its Ombudsman Scheme by legally trained personnel, including retired judicial officers or lawyers with at least ten years’ experience.
The impugned directions were stated to pose significant operational and financial challenges to the RBI’s nationwide grievance redressal mechanism. After hearing Shri Tushar Mehta, Solicitor General of India, appearing for the RBI, the Division Bench issued notice and granted an interim stay on the directions contained in the Single Judge’s order. The Court observed that the directions went beyond the scope of powers under Article 226 of the Constitution of India.
The interim stay provides substantial relief to the RBI by suspending the operation of the directions modifying the Ombudsman Scheme and directing the filing of an affidavit of compliance, thereby preserving the operational integrity of a key regulatory function.
