Khaitan & Co represent KEC International Limited in Writ Petition before the Gauhati High Court

The leading law firm in India, Khaitan & Co successfully advised and represented KEC International Limited in a Writ Petition before the Hon’ble Gauhati High Court, Itanagar Bench, seeking a refund of tax assessments for the assessment periods of 2015-16 to 2017-18 and interest on delayed payment of refund for the assessment years 2013-14 and 2014-15, under the provisions of the Arunachal Pradesh Goods Tax Act, 2005.

It was argued on behalf of the client that the provisions of the Act create a statutory obligation which is not discretionary, and that an assessee is entitled to statutory interest where refunds are not granted within the prescribed period.

The Hon’ble Court accepted the submissions and held that the statutory provisions of the Act unequivocally mandate that refunds must be released within one month, failing which interest computed daily at the prescribed rate becomes payable.

The Court directed the Respondents to release all admitted and accepted refund claims along with statutory interest within four months from the receipt of the certified copy of the judgment.

The firm was responsible for strategy formulation, case assessment, drafting and filing of counter affidavits and written submissions, and arguing before the Hon’ble High Court of Gauhati, Itanagar Bench on behalf of KEC International Limited.
