Punjab & Haryana High Court directs tax authorities to consider installment facility for Spicejet

The Punjab and Haryana High Court directed the tax authorities to consider providing an installment facility to the Petitioner – Spicejet, to clear its tax liabilities.

The matter titled Spicejet Limited v. Excise and Taxation Officer & Ors, was placed before a Division Bench of the High Court of Punjab and Haryana comprising Justices Ajay Tewari and Karamjit Singh.

This petition was filed challenging the notice issued to the Petitioner – Spicejet Limited, to discharge its statutory tax dues or provide an alternative remedy of installment facility to clear its tax liabilities.

The Petitioner contended that operations of the company were curtailed because of the pandemic as well as because of Government control. A representation was also made by the Petitioner regarding this issue before the tax authorities but it has not been decided.

The bench after hearing the arguments of the Petitioner, found their prayer to be a fair one. Therefore, it directed the tax authorities to decide the Petitioner's representation by passing a speaking order within a period of two weeks from the date of receipt of this order.

The Court, therefore, disposed of all other applications arising from this matter as the main issue with regards to the tax liability had been decided.
