Background of the Dispute

The judgment delivered on December 9, 2025, concerns disputes under the 2011 Concession Agreements for integrated waste management projects in Jalandhar and Ferozepur. The corporations challenged the awards and sought an unconditional stay but failed to comply with the Commercial Court’s condition to deposit the full awarded amount. Consequently, their objections were dismissed.

The Hon’ble High Court held that objections need not be examined on merits when parties wilfully defy stay conditions, reinforcing swift enforcement of arbitral awards and discouraging delay tactics by statutory bodies. Both appeals were dismissed, upholding the Commercial Court’s order and the arbitral awards directing payment of ₹92.29 crores (Moga) and ₹204.44 crores (Jalandhar) with interest.
