Supreme Court Collegium Proposes Transfer of Justice Gaurang Kanth from Delhi High Court to Calcutta High Court

The Supreme Court Collegium recommended the transfer of Justice Gaurang Kanth of Delhi High Court to Calcutta High Court.

The Collegium headed by Chief Justice of India Justice DY Chandrachud in its resolution passed said that in terms of the Memorandum of Procedure, consulted one of the judges of the Apex Court who, being conversant with the affairs of the Delhi High Court, is in a position to offer views on the proposed transfer.

The proposal read, “The Chief Justices of the High Court of Delhi and High Court at Calcutta whose opinion was sought in terms of the Memorandum of Procedure have also conveyed their no objection to the proposed transfer of Mr. Justice Gaurang Kanth.”

Additionally, while reiterating its recommendation dated 5 July to transfer the judge to Calcutta High Court, the Collegium rejected Justice Kanth’s request to transfer him to Madhya Pradesh High Court or Rajasthan High Court or any other neighboring State.

The Collegium had carefully gone through the request made by Mr. Justice Gaurang Kanth in his representation, however, the Collegium did not find any merit in the request made by him.

Justice Gaurang Kanth served as counsel for Directorate of Enforcement, National Dope Testing Laboratory, Delhi State Industrial and Infrastructure Development Corporation, Employees Provident Fund Organization, Employees State Insurance Corporation, Chandigarh Housing Board, Bharat Heavy Electricals Limited, etc.

He was appointed as Judge of Delhi High Court on 18 May, 2022.
