Reckitt Benckiser Pvt. Ltd. – manufacturer of the famous brand “DETTOL” sought permanent injunction in the Delhi High Court against a company which used the trademark “DEVTOL” alleging it infringed the trademark of the famous brand.

The High Court directed the company – Mohit Petrochemicals Pvt. Ltd. to stop using the name “DEVTOL” and also imposed a fine of Rs. 1 lakh on the company and directed that the amount be deposited in the Juvenile Justice Fund within one week.

Justice Rajiv Shakdher said of the Delhi High Court said, “To be noted, the plaintiff is a manufacturer of a well-known antiseptic which is sold under the registered trademark and logo ‘Dettol’. The plaintiff has approached this Court seeking various reliefs against the infringing mark and logo i.e. ‘Devtol.’” The order was passed after the counsel for Mohit Petrochemicals made a statement that they will not manufacture and/ or sell the product, the hand sanitizer under the infringing mark “DEVTOL”. The defendant’s counsel also stated that the company has initiated the withdrawal of the infringing mark and has already written to its agents and dealers to withdraw the product bearing the infringing mark from the market.
