Justice Rakesh Kumar has been transferred from the Patna High Court to Andhra Pradesh High Court. On 30th October 2019, a notification has been issued by the Central government stating that in exercise of powers conferred by Article 222 (1) of the Indian Constitution, Justice Rakesh Kumar will assume charge of his new office on or before November 13, 2019.

The Supreme Court collegium had recommended his transfer on 15th October 2019. Making stinging observation over the alleged corruption in judiciary, Justice Kumar had ordered a CBI probe and an enquiry by the Patna district judge into how a former IAS officer KP Ramaiah whom he had denied anticipatory bail in a corruption case last year was granted regular bail by a trial court. On August 28, Justice Rakesh Kumar had disposed an anticipatory bail plea filed by former IAS officer KP Ramaiah for embezzling over Rs. 5 crores in the Bihar Mahadalit Vikas Mission fund scam.

He had said that corruption in Patna High Court is an open secret and that judges were more interested in 'enjoying privileges' than administering justice.

Thereafter, a full bench of the Patna High Court, headed by Chief Justice AP Shahi, set aside Justice Kumar’s order, terming it as an instance of judicial and administrative overreach and a complete nullity.

Later, all cases were withdrawn from him as he hit out publicly at other judges and the High Court administration. An 11-judge bench of the High Court had also suspended Justice Rakesh Kumar's order and ruled that no action ordered by him will be taken.
