Injustice to Complainant

How can a person accused of improper behavior, howsoever high position he may hold, institute any committee or any institution, within or without, call for investigation into the complaint? The whole manner of handling the case is inappropriate and insidious. How can a person accused of improper behavior, howsoever high position he may hold, institute any committee or any institution, within or without, call for investigation into the complaint? Can a nation remain beholden to such insidious investigation? Please do not make a mockery of law. Thankfully, in India, fairness and natural justice is being followed, from the beginning or at some stage of the trial. Till date, no such procedure has been initiated and no such procedure should be followed at any point of time.

Former Supreme Court judge, Justice Madan B. Lokur has voiced doubts about the manner in which the Supreme Court of India has dealt with sexual harassment allegations raised by a former employee of the Court against the Chief Justice of India, Justice Ranjan Gogoi. He has clearly written in an article in the Indian Express titled, “A One Sided Justice”, that the Court was driven by institutional bias while dismissing the allegations raised by the victimized woman.

The intelligence of a nation is rated on the scale of not what is cursorily seen as ideal and correct but what is critically, relevantly and technically seen as ideal and correct. The Supreme Court of India, the highest seat of justice in the land, has miserably failed to follow this procedure, thus exposing itself and its topmost components as laughing stocks before the entire universe.

Let the president suspend the Chief Justice of India (CJI). Or let him recuse himself in order to save face. Let not the name of the nation be blasphemed for the sake of one accused of a serious breach of moral, ethical or technical misconduct. The whole exercise or malfunction of justice in this case stands exposed.

For the sake of fairness and natural justice, the whole judicial procedure followed consequent to the complaint should be nullified, the accused and the complainant treated as would any normal individual be treated, and the CJI given a dose of his own medicine right from the initial stages of law to its logical conclusion.
