A petition has been moved in the Delhi High Court seeking directions to the central government as well as the Law Commission of India to constitute a judicial commission or a high level expert committee to draft a Uniform Civil Code.

The petition has contended that gender justice, equality, and dignity of women guaranteed under various Articles of the Constitution cannot be secured without implementing Article 44, the purpose of which is to introduce a Uniform Civil Code.

The petition has reiterated that the executive branch never took serious steps to implement Article 44.

Meanwhile, the court tagged this petition with a similar petition, which had sought framing of a Uniform Civil Code in order to promote fraternity, unity and national integration.

Incidentally, the second petition which has been filed by Bharatiya Janata Party (BJP) leader Ashwini Upadhyay was also been listed for hearing.

Incidentally, it may be recalled that the All India Muslim Personal Law Board (AIMPLB) had moved an application in the high court recently, seeking to be impleaded as a party in the petition moved by the BJP leader.

The AIMPLB petition had contended that the BJP leader’s petition is not maintainable under the law and sought its dismissal.
