The Supreme Court has refused to entertain a fresh public interest litigation (PIL) seeking linkage of Aadhaar with social media profiles.
The Supreme Court stated that a similar case is pending before the Madras High Court.
The petition was filed by Advocate Ashwini Kumar Upadhyay was taken up by a bench comprising Justice Deepak Gupta and Justice Aniruddha Bose.
However, the Supreme Court also urged the petitioner to approach the concerned high court, and thus expressed its inclination to dismiss the petition.
This prompted Upadhyay to seek liberty to withdraw the PIL. The request was granted by the Court, and the petitioner is now at liberty to move the High Court should he wish to pursue the matter.
Incidentally, the same bench is in the process of hearing the petition filed by social media giants Facebook and WhatsApp which has sought to transfer cases relating to social media profiles and Aadhaar linkage from various high courts to the Supreme Court.
It may be recalled that during a previous hearing, the Supreme Court had granted time to the central government to place on record its affidavit laying down a timeline within which it intends to frame guidelines on the subject.
Significantly, the Madras High Court has also been hearing a number of petitions relating to social media misuse. One of the main cases before it pertains to a PIL kept pending to navigate ways in which online crime may be curbed with the assistance of social media companies.
