Myanmar Releases New Rules Governing Geographical Indications (GIs)
The Government of Myanmar has strengthened its intellectual property framework with the introduction of comprehensive regulations governing the protection, registration, and use of geographical indications (GIs). The Ministry of Commerce has issued Notification No. 103/2025, introducing the Geographical Indication Rules, and Notification No. 104/2025, outlining the formats and forms required for GI-related procedures. Together, these notifications operationalise the GI regime under the Trademark Law of 2019.
Regulatory Framework Introduced
The newly released GI Rules establish a complete regulatory mechanism covering the entire lifecycle of GI protection in Myanmar. They include provisions related to application filing, examination, opposition, cancellation, invalidation, and other administrative processes. The rules also mandate that foreign applicants must appoint a local representative when seeking GI protection in Myanmar.
Eligible Applicants and Scope of Protection
Under the Trademark Law and the Rules, both domestic and foreign legal entities may apply for GI registration if they represent a recognised group of stakeholders such as
- Producers of Natural Resources,
- Agricultural Goods,
- Handicrafts, or
- Industrial Products.
Relevant government authorities are also permitted to file applications before the Intellectual Property Department.
Use of GI Logo and Authorization Requirements
A dedicated procedure has been introduced for obtaining authorization to use the official GI logo. Any local or foreign individual who produces or trades a registered GI product within the designated geographical region may apply, provided they:
- Are members of the relevant stakeholder organization, and
- Comply fully with the prescribed product specifications.
Upon approval, the GI logo may be displayed on packaging, labels, or stickers.
Pending Operational Details
Although the regulatory structure has been established, certain operational aspects remain pending. The government has yet to announce the official fees for GI-related procedures and the commencement date for accepting GI applications. These updates are expected to be released in subsequent notifications.
