Babu Sivaprakasam is the Founding and Managing Partner of LEx Aeterna Practices (LEAP). He is a distinguished and leading practitioner in India predominantly in the areas of Banking & Finance, Real Estate and Stressed Assets Resolution, Insolvency & Bankruptcy practice and brings to the table over three decades of diverse and rich experience in these sectors. Babu’s expertise lies in all forms of Banking & Finance and Real Estate matters including transactional, advisory, governance and compliance. These extend to property and stamp laws, securitization, debentures, mezzanine & debt capital market transactions and transfer & management of stressed assets, trade and documentary credit transactions, derivatives, structured & syndicated finance, collateralized debt obligations, commercial real estate, commodities, aircraft and ship finance transactions and advise on banking product development, standardization of documents and legal risk management. He has extensively advised and worked closely with major public-sector banks, foreign and private banks, non-banking finance companies, funds, and top realty firms in India.

He has experience in resolution of stressed and non-performing assets under various schemes of RBI like CDR, Strategic Debt Restructuring (SDR), Sustainable Structuring of Stressed Assets, RBI’s recent revised framework, including structuring, conducting legal due diligence, and drafting of definitive documents. Babu has significant experience in India’s insolvency laws and has represented various stakeholders including financial creditors, operational creditors, resolution applicants and resolution professionals and has advised Committee of Creditors and represented them before NCLT. His stressed assets resolution and insolvency experience includes preparation and filing of various applications before NCLT, submission of forms & claims before Resolution Professionals, advising and providing legal support & assistance to the Resolution Professionals during the entire Corporate Insolvency Resolution Process, conducting legal due diligence and preparing resolution plans for Resolution Applicants etc.

Prior to LEAP, Babu as a Senior Partner at ELP was heading the Banking & Finance, Real Estate and Stressed Assets Resolution, Insolvency & Bankruptcy practice of the firm. He was a co-founding partner at SNG Partners, where he was responsible for the Banking & Finance and Real estate practices. He earlier served as an in-house counsel in Standard Chartered Bank, Axis Bank and Bank of Baroda. Babu began his career as a practicing lawyer in Chennai High Court.

Babu frequently contributes as a speaker at various conferences, seminars, and conclaves, regularly authors articles and is often quoted in India’s leading publications.
