Khaitan & Co. advised Haldia Energy Limited in 2 (two) tariff-related appeals worth over ₹300 crore before APTEL
Khaitan & Co. advised Haldia Energy Limited (HEL) in two high-stakes appeals before the Appellate Tribunal for Electricity (APTEL). In its judgments dated April 30, 2025, APTEL allowed the appeals filed by HEL against tariff-related orders passed by the West Bengal Electricity Regulatory Commission (WBERC), involving claims exceeding ₹300 crore.
The appeals were filed by HEL due to the disallowance of several cost components and expenditures related to generation and transmission assets. APTEL, in its judgments, addressed technically complex tariff issues and provided a comprehensive analysis of the regulatory and contractual framework.
This outcome marks a significant legal victory for HEL, as the WBERC’s disallowances would have had substantial and cascading financial effects across the current and subsequent tariff periods.
