Khaitan & Co Advised Leading Global IT/Ites And Business Process Outsourcing Company Before Central Government
The appeal was filed under the EPF Act
Khaitan & Co has represented a leading global IT/ITeS and business process outsourcing company before the Central Government Industrial Tribunal (CGIT)-I, Mumbai.
It was done on a statutory appeal under the Employees' Provident Funds (EPF) and Miscellaneous Provisions Act, 1952.
The law firm secured an interim order dated 22 May 2025, which stayed the impugned order under Section 7A of the EPF Act, assessing the liability at Rs. 26.08 crore, subject to the deposit of 10 percent of the assessed amount.
While the deposit requirement for admission of an appeal can go up to 75 percent, it is usually between 30 to 50 percent.
Initially, due to the CGIT-I being vacant, Khaitan & Co approached the Bombay High Court seeking leave to move the stay application before CGIT-II.
The court allowed it on 14 November 2024.
Thereafter, the CGIT-II granted an interim stay on 02 December 2024.
On 22 May 2025, upon completion of pleadings and final hearing, the CGIT-I granted a stay on the impugned order till the disposal, subject to the deposit of 10 percent of the assessed amount.
As a precondition for admitting an appeal, securing a deposit of 10 percent was significant. It substantially lowered the company’s immediate financial outlay, thereby minimizing its financial exposure and preserving crucial liquidity.
