Aspi Chinoy


Aspi Chinoy is one of the senior-most advocates of the Bombay High Court, and is considered one of the country’s finest lawyers, highly respected by his peers in the legal fraternity as well as by the judiciary. After studies at St Xavier’s College and Government Law College in Mumbai, he began practicing law at the Bombay High Court. He is especially noted for his expertise in Constitutional and Commercial cases as well as Public Interest Litigation.

Mr. Chinoy commenced practicing law at the Bombay High Court, the Supreme Court of India & other High Courts in the year 1977. He has been designated as a Senior Advocate. His practice has been focussed on Constitutional/administrative law cases and he has appeared in a number of cases of considerable public importance. According to him if facts evoke the justice of a case, a lawyer is bound to succeed. The law can supplement and support it. On the other hand, if the facts do not evoke the justice of a case, no amount of ‘law’ is going to save the day.

Over the last ten to fifteen years, he has also participated in a number of International Commercial Arbitrations held in London (ICC, LCIA) and in Singapore (SIAC).

He has appeared in Dwarkadas Marfatia’s case relating to the applicability of constitutional limitations on the role of the State/Public Authority as a Landlord; the Vodafone taxation case – which resulted in the retrospective legislation to tax overseas transfers of shares/control of an Indian company; holding Political parties accountable for public losses caused by calling & enforcing “Bandhs” and the challenge to the Maharashtra Amendment Act of 1995 prohibiting the possession & consumption of Beef.

He has also appeared in the BALCO case (which resulted in a much-needed course correction from the Bhatia Judgement) and in a number of Petitions challenging/defending domestic Awards and in a number of Petitions seeking/enforcement of Foreign Awards in arbitration matters.
