Delhi High Court in Insurance Policies for Advocates: Ensure all lawyers to update data before 30 January 2021
At the time of receiving a claim, if any data discrepancy is found, correction of the data would be permitted by the New India Assurance Company Limited after verification
The Government of NCT Delhi (GNCTD) through its status report informed the Delhi High Court that, out of a total of 29,098 advocates the data in respect of
11,168 advocates have been updated.
The order was passed on 15 January 2021 by a single judge, Justice Pratibha M Singh who heard the grievance raised by the Bar Council of Delhi (BCD) that some lawyers were unable to open the link for updating their personal data for the insurance scheme.
The Court stated that considering the fact that the GNCTD and the BCD have been entrusted with the responsibility to design the insurance policy possible for lawyers, they shall adopt a coordinated and collaborative approach to ensure that all lawyers update their data on or before 30 January 2021.
The Court asserted that in case all lawyers do not update their data, the data as is available with the GNCTD or BCD shall be given to the New India Assurance Company Limited who will then issue e-cards to all the eligible advocates.
The Court emphasized that at the time of receiving a claim, if any data discrepancy is found, correction of the data would be permitted by the New India Assurance Company Limited after verification with the BCD or GNCTD.
The final data shall be transmitted to NIACL on or before 5 February 2021 and the e-cards shall be issued by NIACL on or before 15 February 2021, ordered the Court.
Further, with respect to excess premium amounts in terms of the order dated 15 December 2020, Court stated that it shall be retained till 28 February 2021. Additionally, it was submitted that insofar as the Life Insurance Corporation of India (LIC) is concerned, the PDF's of the policies are stated to have been communicated to a majority of lawyers and only a few lawyers are left.
The Court directed BCD to keep in touch with LIC so that the policies are issued to all the lawyers who are beneficiaries under the scheme.
The matter was listed on 12 February 2021 for further hearing.
