Dentons Link Legal secures Letters of Administration without Will for client before Bombay High Court
The global law firm Dentons, through its Indian presence Dentons Link Legal, successfully secured favourable orders granting Letters of Administration without the Will annexed before the Hon’ble Bombay High Court.
The firm represented a client facing significant difficulties in realizing and administering the estates of his parents, both of whom had passed away intestate. The deceased were governed by Muslim Personal Law, and in the absence of a Will, the client encountered practical and procedural impediments in managing the estates.
Although there is no statutory limitation for filing a petition seeking Letters of Administration, the petitions in this matter were filed over nine years after the demise of the client’s father and five years after the demise of the client’s mother. Dentons Link Legal successfully navigated this complexity and secured favourable orders in both matters.
While both testamentary petitions were filed contemporaneously and heard together, the petition relating to the client’s mother’s estate was procedurally contingent upon a prior order in the father’s petition, requiring careful legal structuring, coordinated advocacy, and strategic sequencing of relief. Throughout the proceedings, Dentons Link Legal provided strategic advice and ensured timely compliance with all procedural requirements.
