DMD Advocates Secures Victory for Boeing India in Delhi High Court; Assessment Order Held Void Ab Initio
The leading law firm in India, DMD Advocates, successfully represented Boeing India Private Limited (BIPL) before the Delhi High Court in a matter concerning the final assessment order issued by the Revenue.
Background
The Hon’ble Delhi High Court dismissed the Revenue’s appeal, holding that the final assessment order dated March 30, 2021, was void ab initio. The order had been issued in the name of the erstwhile amalgamating entity, Boeing International Corporation India Private Limited (BICIPL), instead of the amalgamated entity, Boeing India Private Limited (BIPL).
Facts of the Case
The assessee had informed the Revenue about the amalgamation in its reply to the Notice under Section 142(1) of the Act, providing details regarding the amalgamated entity. Despite having knowledge of the amalgamation, the Revenue proceeded to pass the final assessment order in the name of the amalgamating entity (BICIPL).
Court’s Observations
The Delhi High Court upheld the ITAT’s decision quashing the final assessment order. The Court emphasised that in tax matters, there must be a consistent level of certainty, as deviations create unnecessary incertitude, which must be avoided.
