P&A Law Offices represents HPCL in arbitration; Sole Arbitrator rejects VSPL’s claims
The leading law firm primarily based in India with a growing international presence, P&A Law Offices successfully represented Hindustan Petroleum Corporation Limited (HPCL) in an arbitration arising out of the “Tankage Works for Mumbai Refinery Expansion Project of HPCL Mumbai.”
A Sole Arbitrator appointed by the Bombay High Court rejected all claims of Vishal Structurals Private Limited (VSPL) amounting to approximately INR 26.5 crores. VSPL had alleged that HPCL failed to provide work fronts, leading to delays in the project. HPCL, on the other hand, contended that VSPL defaulted on the contract and abandoned the project, which compelled HPCL to terminate the contract.
The Sole Arbitrator held that VSPL had failed to establish its readiness and willingness to execute the contract works. Consequently, all claims raised by VSPL were rejected. On the contrary, HPCL was awarded approximately INR 44.55 lakhs towards interest on Mobilization Advance and INR 28 lakhs towards legal fees and expenses. The Arbitrator also rejected VSPL’s belated application for leading rebuttal evidence.
HPCL was represented by Mr. Zubin Behramkamdin (Senior Counsel) and Mr. Rashmin Khandekar (Counsel), briefed by P&A Law Offices at the final hearing stage and for the rebuttal application, respectively. Evidence in the matter was conducted by Mr. Vijay Purohit (Partner), assisted by Mr. Pratik Jhaveri (Principal Associate) and Mr. Samkit Jain (Senior Associate) of P&A Law Offices.
