P&A Law Offices successfully represented the Republic of India in landmark international investment arbitration
The leading law firm in India, P&A Law Offices successfully represented the Republic of India in a landmark international investment arbitration against Korea Western Power Company (KOWEPO), administered by the Permanent Court of Arbitration (PCA) at The Hague, The Netherlands.
The dispute related to investments made by KOWEPO in a gas-based power plant located in the State of Maharashtra.
The arbitral Tribunal has rendered its Award and dismissed all the claims of KOWEPO in their entirety, marking a significant victory for the Republic of India.
In November 2019, the Tribunal was constituted in accordance with the United Nations Commission on International Trade Law (UNCITRAL) Arbitration Rules 1976, with the seat of arbitration at Singapore. The claim had been submitted under the Bilateral Investment Treaty of 1996 between the Republic of Korea and the Republic of India.
The Singapore-seated Tribunal was chaired by USA’s Ms. Jean Kalicki, with Dr. Kaj Hobér from Sweden and Ms. Brigitte Stern from France serving as the other arbitrators.
The Republic of India was represented by P&A Law Offices in New Delhi, Mayer Brown in Paris, and various government officials.
