S&A Law Offices Secures Landmark Verdicts in High-Value Arbitration Dispute for JITF Urban Waste Management

S&A Law Offices has successfully secured significant verdicts for its clients, M/s JITF Urban Waste Management (Ferozepur) Ltd. and M/s JITF Urban Waste Management (Jalandhar) Ltd., in two major matters before the Hon’ble Punjab and Haryana High Court against Municipal Corporation, Moga and Municipal Corporation, Jalandhar. The Hon’ble Court dismissed the appeals filed by the Municipal Corporations and paved the way for the enforcement of the arbitral awards, thereby upholding the sanctity of the Arbitration and Conciliation Act, 1996.
Background of the Dispute
The judgment delivered on December 9, 2025, concerns disputes under the 2011 Concession Agreements for integrated waste management projects in Jalandhar and Ferozepur. S&A Law Offices successfully represented the Clients and secured favourable awards for the Clients in the arbitration proceedings. The corporations challenged the awards and sought an unconditional stay but failed to comply with the Commercial Court’s condition to deposit the full awarded amount. Consequently, their objections were dismissed.
High Court Ruling
The Hon’ble High Court held that objections need not be examined on merits when parties wilfully defy stay conditions, reinforcing swift enforcement of arbitral awards and discouraging delay tactics by statutory bodies. Both appeals were dismissed, upholding the Commercial Court’s order and the arbitral awards directing payment of ₹92.29 crores (Moga) and ₹204.44 crores (Jalandhar) with interest.
