Hafez & Partners and DLA Piper Acted on Securing Aircraft for Lessor

Hafez & Partners (H&P) and DLA Piper successfully collaborated to reclaim an aircraft for an international lessor, the asset having been wrongfully detained by the lessee in violation of the Aircraft Lease Agreement. Ahmed Hafez, Managing Partner at H&P, led the team alongside Karim G. Ghorab, Counsel and Head of Dispute Resolution. They partnered closely with aviation experts Tony Payne, Partner and Global Head of Aviation, and Eric Oehy, Associate, from DLA Piper, who served as lead counsel for the lessor.

For nearly two years, H&P and DLA Piper's aviation team faced unprecedented technical, legal, and practical hurdles to recover the lessor's aircraft. They navigated the complexities with open communication and negotiation, both with government authorities and the lessee. This constructive dialogue ultimately addressed regulatory concerns regarding the grounded aircraft's non-airworthiness and paved the way for its successful repossession.
