Modi-Mundipharma Wins Interim Relief Against Agrosaf Over Trademark Dispute
High Court grants interim relief to Modi-Mundipharma
The Delhi High Court has restrained Agrosaf Pharmaceuticals Pvt. Ltd. and Jineka Healthcare Pvt. Ltd. from using the trademark "AGROCONTIN" due to its similarity to Modi-Mundipharma's "CONTIN" brand.
The court's decision is based on the potential for consumer confusion due to the phonetic similarity between the two marks. Modi-Mundipharma has a strong portfolio of registered trademarks, including "NITROCONTIN" and "PHYLLOCONTIN," establishing its presence in the pharmaceutical industry.
The court noted that the defendants' use of the "AGROCONTIN" mark could be an attempt to benefit from Modi-Mundipharma's reputation.
The plaintiff was represented by team Anand & Anand led by Mr. Pravin Anand, Ms. Prachi Agarwal, Mr. Manan Mondal, and Ms. Elisha Sinha, Advocates.
