Ola Electric's Bharat Cell Trademark In Dispute: Delhi High Court Directs Mediation
The Delhi High Court directs parties to attempt amicable resolution through mediation in trademark dispute over 'Bharat Cell' mark.
The Delhi High Court has referred a trademark dispute between lithium-ion battery maker Kushmanda Power Limited (KPL) and Ola Electric to mediation. The dispute revolves around the use of the mark 'Bharat Cell' for electric vehicle battery cells. Justice Saurabh Banerjee directed the parties to attempt an amicable resolution through mediation under the aegis of the Delhi High Court Mediation and Conciliation Centre.
KPL had filed a suit claiming that Ola Electric's branding of its battery as "Bharat Cell" amounted to trademark infringement and passing off. KPL assembles and markets lithium-ion battery packs under the brand "BHARATCELL." However, neither party currently has a registered trademark for "Bharat Cell."
KPL's application for "BHARATCELL" is under opposition, while Ola Electric's application for "Bharat Cell" is still at the initial stage of processing.
The Court opined that the matter was suitable for mediation, particularly since the trademark rights were yet to crystallise. The Court also noted that KPL filed the plea in May 2025, despite Ola Electric's announcement of Bharat Cell in August 2024, and therefore, there was no urgency in the matter. The case will now come up for hearing before the Court in August.
