Phillip is a commercial disputes partner, head of the IT and IP disputes team and co-head of the India group at Penningtons Manches Cooper. He has over 20 years’ experience of complex, high value commercial litigation and arbitration, often with a cross-border element, and regularly advises on commercial, technology, financial services and civil fraud disputes, as well as enforcement and asset recovery.
Phillip has acted on a number of board and shareholder, banking and IT disputes and represents a range of private sector clients. He assists businesses and individuals with insolvency and regulatory compliance issues, and has a particular interest in contentious and transactional work involving India, having acted on several English law disputes involving Indian parties.
He is recommended for both banking and commercial dispute resolution in The Legal 500, where he is described as being ‘a particularly astute tactician’. Phillip regularly writes, speaks and provides training on a variety of topics.
His recent work include: Representing a property brokerage client in a multimillion pound claim in the High Court for breach of contract and quantum meruit against a leading global property management company; assisting a client to achieve a negotiated settlement in a contractual dispute with an IT systems supplier in relation to breach of development, hardware and support agreements for the supply of a pricing management system to evaluate GP prescriptions; successfully representing a leading vehicle distributor in High Court proceedings for conspiracy, deceit and conversion of company assets against former employees and their associated companies; acting for a hospitality sector client in a multimillion pound worldwide freezing order claim involving breach of trust, bailment, fraud and conversion in the Chancery Division and before the Court of Appeal.
He was also successful in securing an advantageous settlement on behalf of a claimant in a claim for breach of contract and/or quantum meruit for the introduction of key clients to a global supplier of extranet services to the financial services industry during the establishment of its operations.
