YFLG secures acquittal in USD 17 million real estate fraud and money laundering case
The Kuwaiti corporate law firm, Al-Yaqout & Al-Fouzan Legal Group (YFLG) successfully secured the acquittal of a businessman in criminal proceedings involving allegations of money laundering and real estate fraud amounting to approximately USD 17 million. The acquittal, originally granted by the Criminal Court at first instance, was upheld by the Court of Appeal.
The case arose from accusations by the Public Prosecution that the defendant had engaged in fraudulent real estate projects and money laundering. Following a thorough review of the evidence and submissions, the defence demonstrated that the projects were legitimate, operational, and civil in nature, not giving rise to criminal liability. The Court of Appeal affirmed that the elements required to establish criminal intent were not met.
The defence was led by Abdullah Al-Obaidli (Partner and Head of Litigation) and Dr. Anwar Al-Fuzaie (Senior Partner, Litigation), with support from Mahmoud Ramadan (Associate). The team presented detailed legal submissions and documentary evidence, successfully challenging the evidentiary basis of the allegations and the claim of criminal responsibility.
