Union Government seeks recommendation on Draft Mediation Bill, 2021
The objective of the Act states,
"An Act to promote, encourage and facilitate mediation especially institutional mediation for resolution of disputes commercial and otherwise, enforce domestic and international mediation settlement agreements, provide for a body for registration of mediators, to encourage community mediation and to make online mediation as an acceptable and cost effective process and for matters connected therewith or incidental thereto."
The Act is divided into III parts; Domestic Mediation, Community Mediation and Enforcement of International Commercial Settlement Agreements Resulting from Mediation.
Salient Features of the Act:
1. Pre-litigation mediation
2. Outcome of Mediation made enforceable – Challenge permitted only on limited grounds
3. Maintenance of Confidentiality
4. Registration of Mediation Settlement Agreement
5. Provides for community mediation.
