Khaitan & Co advised Husky Group on securing ‘nil’ anti-dumping duty in DGTR investigation

Khaitan & Co successfully advised and represented the Husky Group in the anti-dumping investigation conducted by the Directorate General of Trade Remedies (DGTR) concerning the import of Plastic Processing Machinery originating in China and Taiwan, and exported from any country, including China PR and Taiwan.

The representation covered the following manufacturing and exporting entities:

  • (i) Husky Injection Molding Systems SA., Luxembourg
  • (ii) Husky Injection Molding Systems Shanghai Ltd., China
  • (iii) Husky Injection Molding Systems Ltd., Canada
  • (iv) Husky Injection Molding Systems India (Pvt.) Ltd.

The DGTR undertook the investigation to determine dumping margins and injury levels and to consider the imposition of anti-dumping duties for a period of five years. All interested parties were required to participate in the proceedings by submitting detailed questionnaire responses, data, records, and legal submissions, and by appearing for hearings before the authority.

Based on the comprehensive legal and factual submissions, the DGTR determined and notified a ‘nil’ rate of anti-dumping duty on exports made by the Husky Group from China for five years. This outcome was particularly significant given that other exporters from China have been subjected to anti-dumping duties ranging between 48% and 63%. The Husky Group stands as the only interested party from China to have secured a ‘nil’ rate, providing a considerable competitive advantage in the Indian market.

Following DGTR’s recommendation, the Central Government issued Notification No. 21/2025 – Customs (ADD), formally confirming the imposition of anti-dumping duties while exempting the Husky Group from any such levy.

Khaitan & Co advised the client on all aspects of the proceedings, including strategic representation, data collation, legal drafting, submission before the DGTR, and hearing appearances.
