Gourab Banerji Now On Expert Group Of Permanent Court Of Arbitration
The group has been formed to observe the 125th anniversary of the PCA and to ensure its continued relevance in the evolving landscape of international dispute resolution.
Senior Advocate and President of the Arbitration Bar of India, Gourab Banerji, has been appointed member of the Expert Group on the Future Development of the Permanent Court of Arbitration (PCA) at the Hague.
The group has been formed to observe the 125th anniversary of the PCA and to ensure its continued relevance in the evolving landscape of international dispute resolution.
An international organisation established in 1899 under the Hague Convention to facilitate resolution of disputes between states, international organisations and private parties, the PCA is headquartered in The Hague, Netherlands. It provides services for mediation, arbitration and other forms of dispute resolution in matters related to territorial, investment and commercial conflicts.
The PCA does not have permanent judges like a traditional court; it maintains a panel of arbitrators instead from which disputing parties can choose. The PCA has 124 contracting parties.
The organisation’s Administrative Council requested the PCA Secretary-General to constitute the Expert Group to reflect on its historical contributions, evaluate its contemporary significance, and develop a strategic vision for its future.
The Expert Group is co-chaired by Professor Gabrielle Kaufmann-Kohler and Sir Daniel Bethlehem KC and comprises renowned international judges, arbitrators, legal practitioners and academics who serve in their personal capacities. The 15-member Expert Group includes Dr Mohamed Abdel Wahab, Dapo Akande, Nadia de Araujo, Judge Joan E Donoghue, Sarah Grimmer, Shotaro Hamamoto, Bing Bing Jia, Dyalá Jiménez, Roman A Kolodkin, Ambassador Rena Lee, Salim Moollan KC, Phoebe Okowa, Mónica Pinto, and Danilo Türk alongside Banerji.
The inaugural meeting of the Expert Group was held on March 20-21 at the Peace Palace in The Hague, with several members participating via video conference. The Group’s mandate was launched by the meeting which initiated discussions on the PCA’s role in international dispute resolution.
The Expert Group will analyse historical and forward-looking perspectives on the PCA’s contributions to international law and present its suggestions to the Secretary-General and the Administrative Council in 2026 with support from the International Bureau.
Last year in October, Banerji was appointed as nominee arbitrator in the Bilateral Investment Treaty (BIT) arbitration case of CTF Holdings SA v. Ukraine.
