A Supreme Court bench comprising Justice Rohinton Fali Nariman and Justice S Ravindra Bhat has directed the central government to resolve technical glitches in the online network through which Goods & Services Tax returns are filed.
The SC bench also allowed the central government’s plea to stay a Rajasthan High Court order, which had extended the deadline for online filing of GSTR9 & GSTR9C forms due to technical problems in the GST network.
The stay was granted on the basis of a submission made by Solicitor General Tushar Mehta that only Rs 200 per day is being charged for filing late returns beyond February 12.
Earlier, the Tax Bar Association, which had approached the Rajasthan High Court, told the Supreme Court that the capacity for online processing of GST applications is extremely limited.
On February 5, a bench comprising Chief Justice Indrajit Mohanty and Justice Pushpendra Singh Bhati had directed that no late fee shall be charged until February 12, 2020 for uploading GST returns.
The last date for submission of GSTR9 in Rajasthan was January 31, which was extended to February 5, 2020 after taking technical problems into account.
The Rajasthan High Court had ordered that an assessee, who is ready and willing to submit returns, cannot be made to suffer penalty on account of incapacity of the system.
