Khaitan & Co advised Galderma Holdings S.A., acting in India through Galderma India Private Limited (“Galderma”), in securing a John Doe order from the Bombay High Court to counter the increasing sale of counterfeit goods bearing its well-known trademark ‘CETAPHIL’ across e-commerce platforms and local markets.
On 18 June 2025, the Bombay High Court granted Galderma the John Doe order, allowing it to conduct search and seizure operations. Acting on this order, Galderma, supported by Khaitan & Co and local enforcement authorities, executed simultaneous raids on 2 July 2025 in New Delhi and Mumbai.
In New Delhi, the team raided a manufacturing unit and confiscated over 15,000 finished and unfinished goods, 12,000+ bottle caps, approximately 6,000 ‘CETAPHIL’ stickers, and raw materials. It was discovered that the counterfeiters were producing fake products for other prominent brands as well. In Mumbai, multiple premises in Crawford Market were searched, and counterfeit products were seized, although in limited quantities due to logistical constraints.
