The tribunal observed that the applicant/promoter is not able to construct 8 towers in 9 years whereas a competitor construction company constructed about 50 towers in 3 years. It was submitted that the company blamed 17 problems but refused to admit that it is incompetent and inefficient.

The tribunal presided by a bench of Chaiperson SS Shinde and Member Shrikant Deshpande held that it is not in dispute that the impugned order came to be passed on 29.07.2024. It was held by the tribunal that it may not be necessary to file the certified copy of the impugned order while filing the appeal. Since the same could have been done by submitting the appeal with simple copy of the impugned order under Section 44 (2) of the Real Estate (Regulation and Development) Act, 2016 with an undertaking to submit the certified copy as soon as possible.
